RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT<\/h3>\n

THE FERRARI CLUB OF AMERICA \u2013 CANADA EAST REGION<\/h3>\n

REFER TO MOST CURRENT VERSION AT THE EVENT AND SIGN UPON ARRIVAL<\/h3>\n

In consideration of being permitted to compete, officiate, observe, work for or for any purpose to participate in any and all THE FERRARI CLUB OF AMERICA \u2013 CANADA EAST REGION (FCA) events, each of the undersigned, for himself, his personal representatives, heirs and next of kin:<\/p>\n

    1. Hereby releases, waives discharges and covenants not to sue the THE FERRARI CLUB OF AMERICA \u2013 CANAD EAST REGION, their directors, officers and members, the promoter, participants, sponsors, advertisers, owners and lessees of the premises used to conduct all FCA events, all for the purpose herein referred to as the \u201cReleasees\u201d, from all liability to the undersigned his personal representatives, assignees, heirs and next of kin for any and all loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting death of the undersigned arising out of or related to this event, whether caused by the negligence of the releasees or otherwise.<\/li>\n
    2. Hereby agree to indemnify and save and hold harmless, the releasees and each of them from any loss, liability, damage or cost they may incur arising out of or related to demands, causes of action, or claims brought by or on behalf of the undersigned, the undersigned\u2019s spouse children, heir, next of kin, assigns or any relative or the undersigned whether such claim is based upon the negligence of the releasees or otherwise.<\/li>\n
    3. Herby assumes full responsibility for any risk of bodily injury, death or property damage arising out of or related to any FCA events whether caused by the negligence of releasees or otherwise.<\/li>\n
    4. Herby agrees that the Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extend to all acts of negligence by the releasees and is intended to be as broad and inclusive as is permitted by the laws of the Province of Ontario and is\/are conducted and that if any portion thereof is held invalid, is agreed that the balance shall, not withstanding, continue in full force effect.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

      I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND THE TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT, ASSURANCE OF GUARANTEE BEING MADE TO ME AND INTEND TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILTY TO THE GREATEST EXTENT ALLOWED BY LAW.<\/p>\n
